Open a restaurant
in Lexington.

The path to opening

  1. Check the location before a major commitment.

Discuss the address, current use, seats, menu, cooking equipment, hours, and proposed work with Building/Zoning and Economic Development. Ask about land-use approval, accessibility, signs, historic districts, and occupancy. An existing restaurant is a useful starting point; its approvals do not settle every change you propose.

  2. Set up the business and its records.

Choose the legal entity, obtain an EIN where needed, and file a DBA if your trading name requires it. Register meals tax and applicable employer accounts. Keep formation papers, the lease or deed, insurance, and contact details together. The DBA identifies the business; it is one part of the process.

  3. Review the kitchen and premises plans.

For a brand-new food establishment, begin with Health plan review. Discuss alterations and ownership transfers with Health too. Prepare a proposed menu, scaled layout, equipment information, and operating procedures for review. Coordinate grease handling, plumbing, ventilation, and any zoning, Planning, historic-district, or Conservation review that applies.

  4. Apply for the licenses and work permits.

Coordinate the food permit, Common Victualler license for seated service, and applicable building, trade, and Fire permits. Alcohol, outdoor dining, entertainment, and signage add separate branches. A liquor application involves the Select Board and state ABCC. Start independent applications in parallel where the departments allow.

  5. Complete permitted work and inspections.

Obtain the applicable work permits before construction. Arrange Building, trade, Fire, and Health inspections for your scope, resolve corrections, and obtain the required occupancy approval. Confirm how a no-work takeover should handle Change of Occupancy. Record an inspection request separately from its confirmed appointment and outcome.

  6. Collect the final operating approvals.

Complete the preoperational Health inspection, staff credentials, insurance, and applicable operating licenses. Confirm outstanding items directly with the responsible departments before opening. A complete planning checklist here does not authorize service or alcohol sales.

    Food protection and annual permits
  7. Maintain approvals after opening.

Track actual permit expiry dates, renewals, recurring inspections, and staff training. Ask before changing ownership, menu processes, equipment, seats, or licensed premises. Keep required food-safety and pest-control records available.
